Springfield police arrested a man early Sunday after a woman and witnesses said he tried to rape the woman at knifepoint near downtown.  Marvin Castellanos-Rivera, 26, is charged with attempted rape but he told police that he was in or near a bar “a majority of the night" and couldn't have attacked the woman.

The woman told police that she was walking north on Market Avenue near College Street while talking on her cellular telephone shortly after midnight Sunday.  She said a man came up behind her, pushed her into a wall, grabbed her cell phone, covered her mouth, and held a knife to her throat.

The woman said she screamed for help while the man pulled her across the street into an alley. She said she saw a man riding a bicycle and yelled for help but the man kept riding and looked at here “like he did not know what to do,” according to the probable cause statement against Castellanos-Rivera.

The woman told police that her attacker punched her in the face and told her “don’t look at my face.” The woman said she begged the man not to rob her and he replied, “all I want is sex,” according to the probable cause statement.  The man then pulled down her shorts.

Another man walked by and the woman again yelled for help.  That man told the woman to “come to me,” and the attacker let her go and fled.

The woman and her rescuer described the attacker to police, who found a man matching their description at Softails.  The man on the bicycle told police that he saw the attacker run into the back door of that bar on College Street.  That’s where officers arrested Castellanos-Rivera.

At the Greene County jail, a detective interviewed Castellanos-Rivera.

“Castellanos denied this incident occurred and stated that he was inside Softails a majority of the night. Castellanos stated that the only time he was outside of the establishment was to smoke and he stood by his friend's truck the entire time. During the interview, Castellanos was very concerned about being deported from the United States,” the detective wrote in the probable cause statement.

In a request for a $100,000 bond, prosecutors wrote: “Defendant held a knife to victim’s throat, pushed her against a wall and pul1ed her shorts down approximately six inches. Defendant punched the victim on the left side of her face. This defendant is clearly a threat to the community and this victim in particular. Defendant is also a flight risk; defendant told officers that he has been deported prior to this incident. Defendant stated that he was allowed to come back into the country for a month to take care of child support issues.”

If Castellanos-Rivera is convicted of attempted rape, he could get a prison sentence between five years and life (30 years). He was in the Greene County jail on Monday.
